POLICIES & AGREEMENT
By placing an order with SoBeGraphics.com, you agree to be bound by the following terms and conditions. Please make sure you have read all of the below policies and terms before placing an order. SoBeGraphics.com is not responsible if your order does not meet these terms and requirements.

GENERAL DESCRIPTION
Postcards printed in full color on BOTH sides on 12 point coated card stock. Be wary of competitors who print only full color on one side and either one or two colors on the back, and use either 8 or 10 point card stock. All postcards printed on 4 color offset presses, with over 2 million postcards printed every week. All prices include film and color separations. All cards, except business cards, will have "Printed By: SoBeGraphics.com • 1.866.ASK.SOBE" printed on the back in a 4pt 70% opacity font. You may indicate in the comments section on your order form where you want this to appear or if you wish for it not to appear at all. The removal fee is $50. PRODUCTION & TURNAROUND
Our posted turnaround times begin ONLY after an order has been "received". Orders are considered "received" and are put into production ONLY when the following four conditions have been met:
(1) an ORDER FORM has been completely filled out,
(2) all files have been correctly submitted,
(3) the customer has approved the online proof by signed fax and has given the go ahead to proceed with production, and
(4) payment information has been provided.

After the initial order is placed and your files have been successfully either uploaded, emailed, or snail mailed, a SoBeGraphics.com rep will review your files at no charge. If everything is OK, an online proof will be generated and an email will be sent to you directing you where to go to view your proof. If the proof looks good, you must fax a signed copy of the emailed proof to our offices to give us the OK to continue with production and provide payment information. At this point, the order has been "received" and the turnaround time begins. Once payment information is received and an order enters production, SoBeGraphics.com cannot accept any cancellations. There are also no refunds or returns after this point.

Please remember that orders received by 3pm EST will be treated as if received that day, but orders/files received after 3pm EST will be treated as if received the next business day. For example, an order which meets all four conditions stated above, that is received at 2:45 pm EST on Tuesday will enter Tuesday's production and will be ready for pick-up or shipment either Wednesday or Thursday. An order "received" Tuesday at 3:15pm EST will be treated as being received Wednesday and will be ready for pick-up or shipment either Thursday or Friday.

Please remember that orders for same day service must be received no later than 10am, but orders/files received after 10am EST will be treated as if received the next business day.

We have one of the fastest production times in the country. For quantities of 5,000 or more, a properly received order will be ready for pick-up or to ship via UPS in 48-72 hours. Turnaround time for quantities less than 5,000 is 24-48 hours.

Although we rarely miss production schedules, the printing and pre-press process involves equipment which is subject to malfunctions and/or equipment failure. We will always do everything in our power to make sure that any production problems do not delay your job. However, please note that ALL production and delivery times ARE NOT CONTRACTUAL and no turnaround time can be guaranteed. No verbal or written correspondence by anyone at SoBeGraphics.com can change that. Please try to plan date sensitive materials timely.

PRINTING/CUTTING Please Note: In order to give you better than wholesale prices and the least expensive four color prices in the country, we produce our postcards in a "gang" format on 4 color offset presses. We will make every effort to produce a reasonable representation of your job based on your supplied materials. However, note that SoBeGraphics.com DOES NOT guarantee color matching. All jobs are subject to a 10% overrun or underrun.

COLOR DISCLAIMER: ATTENTION: IF YOUR PRINT JOB IS COLOR CRITICAL a request for a Matchrpint® or Color Proof must be submitted along with your job. COLOR CRITICAL should also be specified when submitting the job(s). Prices for print jobs that are printed in gang run format differ from prices of color critical jobs which need to be printed by them selves as opposed to being printed on a gang run. A gang run is a way of printing jobs for clients which brings there cost down tremendously by printing several print jobs together on the same print run. If a job is color critical then the necessary attention it needs cannot be attained in a gang run format. Therefore the job must be printed by itself losing the discounted price of printing in a gang run format. Color Critical Jobs require a dedicated run and the press be calibrated to run that specific job only rather than a gang run with other print jobs. Color Proofs are not included in our prices. If you submit a job and do not request a Color Proof, your job(s) will be printed as is. SoBeGraphics.com will not be liable for color disparity or variation with the job (within Gang Run Color Disclaimer). If a color proof is chosen by the customer then it will be SoBeGraphics.com's responsibility to match that proof and job will be printed accordingly. SoBeGraphics.com will make every effort to match the colors of your submitted art work; whether your job is color critical or not. SoBeGraphics.com will treat each job as if it were our own. It is you the client’s responsibility to determine weather or not the job is a color critical job or not and please choose your method of print accordingly. ALL Gang run printing is subject to a 10% color variance.

Make sure you have read the accompanying information in POSTCARD SIZES and FILE FORMATS before you upload your files. ALL files must have an 1/4" bleed all around. A $25 fee will be charged to create a bleed if it has not been incorporated in your files. Critical type or images must be at least 1/4" from the edge of the card. SoBeGraphics.com is not responsible for type, art or images that are cut off if these guidelines are not followed. Furthermore, it is strongly suggested that you do not use a thin border around your postcard. This may cause an uneven frame around your card. If you desire to have a border, it should be at least 1/4" thick.
You must adhere to the layout specifications explained in POSTCARD SIZES. Files that do not follow the instructions provided will delay your job and will incur extra charges. If you employ the services of a third party designer make sure that all file submission specifications are understood and followed.

UPLOADING FILES Your files will be automatically sent to our SECURE FTP Site. PLEASE ENABLE YOUR FIREWALL TO ACCEPT AND TO USE SECURE PAGES. Please read the instructions in order to ensure that your order is not held up. We appreciate your cooperation. Estimated file upload time: 15Mb file @ T1 Line (5sg -2min.) 15Mb file @ Cable - DSL Fast Access (2-5 min.) 15Mb file @ Modem 56K (10min.- 30min.) Note: After 30min. of file transfer the server will time out, meaning that your connection was to slow, or your file was too big; please shrink down your file or send it by regular mail to 9351 NW South River Drive, Miami Florida 33166. If you receive a message saying that there was an error or a server error, please use your browser back button to return to this page, try uploading your file one more time and if you still get the same message, please contact: info@sobegraphics.com to inform us of the inconvenience, and we will be more than glad to help you. MULTIMEDIA AND WEB DESIGN: The price quoted for your order ("Quotation") will expire thirty (30) days from the date of the Quotation and are null and void thereafter. A written Quotation will be sent to Customer for review and signature. Customer's signature on the written Quotation and a deposit of fifty percent (50%) of the Quotation are required in order for SoBeGraphics.com to commence work or fulfillment of Customer's order. The remaining balance of fifty (50%) percent is due within six weeks of signing the Quotation. Customer's signature on the Quotation shall comprise your acceptance of the Quotation and Terms and Conditions herein. Deposits are NOT refundable. Prices are subject to change without previous notice once Quotations expire. SoBeGraphics.com, Inc recommends and the Quotations provided are designed for 800 x 600 px screens. Prices for orders not meeting SoBeGraphics.com, Inc recommendations may vary and result in additional charges. This Agreement shall be governed by Florida law and jurisdiction and venue shall be in Dade County Florida. Maintenance Fee is due at the beginning of the month in order to keep web site up and running in server. Detailed time sheet will we sent to customer as proof of the amount of hours invested in each project.

SHIPPING - CARRIERS: Preferred Shipping Methods: Delta Cargo Service Options: Dash $110.00 per box of 50 lb Same day service, if applicable (next available flight). Dash fees, are pre-paid by client, to SoBeGraphics.com. Daily flight cut off time is 6:50 pm.
Delta Cargo is our preferred method of shipment. This is the fastest and most efficient method of shipping to clients, based on our operations. Clients shipping Delta must coordinate destination airport, with SoBeGraphics.com, prior to shipping. Delta Cargo shipping requires you, the client, to pick up the package(s) at the airport within 5 days. If package is not picked up within five days the package will be destroyed due to the new FAA guidelines after September 11th. We are not responsible any for packages destroyed or returned by the carrier. Jobs that will be ready to ship on Friday that are needed for the same weekend must be shipped via airline since UPS will not ship again until Monday. UPS Service Options: Ground Recommended, is time is not critical. Very cost effective. Next Day Prefer the use of Delta. It is generally a much more cost effective method of shipping.

SHIPPING NOTICE & POLICY In order to help ensure that you choose the best possible shipping method for your printing order we are displaying this shipping notice once for each of our customers. Here are some important points to keep in mind when selecting your shipping method: In the event of a lost or damaged shipment, we can guide you through the claims process. However, once a package has been shipped, the shipping company is liable for any losses. We are a PRINTER and we make sure your printing is boxed according to the highest shipping standards. Once your order leaves our facility, we cannot be held liable for any damages to your boxes or your printing. We apologize for any inconvenience. 1) Jobs that will be ready to ship on Friday that are needed for the same weekend must be shipped via airline since UPS will not ship again until Monday. 2) We currently do not ship with FedEx, however UPS ground service and Express service are available. SoBeGraphics.comn will NOT be responsible for shipping Posters or any other project that is being transported flat in a carrier box. High-volume orders may qualify for a discount of up to 25% in shipping. And up to 25% off printing total. Please call us toll-free at 1-866-ASK-SOBE for discounted price. Shipping Rates are for UPS Ground within the U.S.

BINDERY: Any job that requires specific instructions of: Folding front and back Die cutting outlines Drilling outline and dimensions Foil stamping Bleeding margins, etc. Should be submitted with the file at the moment of uploading otherwise SoBeGraphics.com™ is not responsible for the incorrect outcome of your job. Samples are recommended to ensure proper ‘Bindery’ of jobs.

PICK UP: When your order is ready, please use your invoice or order number and company name for pickup. If you are using a messenger service, be certain they have the invoice or order number, and quantity of boxes. Proof of payment and a signature will also be required at time of pick up.

STORAGE EXPIRATION: Orders that are not picked up within 30 days are considered abandoned by the client; unless prior arrangements are made with our office. CD SPECS: The CD inserts are printed on 100# gloss text. Prices include; tray card, printed on 100# gloss text, scoring, and perforating of the tray card. The CD Inserts are a 1 panel insert and tray card. For multi panel CD Inserts please call 1-866-ASK-SOBE.

SERVER STORAGE: Although orders can be placed today and submitted tomorrow, due the volume of orders we process, they will be stored in our servers for only 24 hours. After that the order will have to be placed again.

PAYMENTS We accept cash, money orders, certified/bank checks, Visa, Mastercard, Amex.
Once an order has been received and has entered the production cycle, refunds are not allowed.
Although SoBeGraphics.com does archive files for re-orders, please retain a back-up copy of your postcard. SoBeGraphics.com DOES NOT guarantee that all submitted files will be saved.

LIABILITY: Disclaimer of Express Warranties: SoBeGraphics.com warrants that the work is as described in the purchase order. The customer understands that all sketches, copy, dummies, and preparatory work shown to the customer are intended only to illustrate the general type and quality of the work. They are not intended to represent the actual work performed.

Disclaimer of Implied Warranties: SoBeGraphics.com warrants only that the work will conform to the description contained in the purchase order. SoBeGraphics.com's maximum liability, whether by negligence, contract, or otherwise, will not exceed the return of the amount invoiced for the work in dispute. Under no circumstances will SoBeGraphics.com be liable for specific, individual, or consequential damages.

INDEMNIFICATION: The customer agrees to protect SoBeGraphics.com from economic loss and any other harmful consequences that could arise in connection with the work. This means that the customer will hold SoBeGraphics.com harmless and save, indemnify, and otherwise defend him/her against claims, demands, actions, and proceedings on any and all grounds. This will apply regardless of responsibility for negligence.

Copyrights: The customer also warrants that the subject matter to be printed is not copyrighted by a third party. The customer also recognizes that because subject matter does not have to bear a copyright notice in order to be protected by copyright law, absence of such notice does not necessarily assure a right to reproduce. The customer further warrants that no copyright notice has been removed from any material used in preparing the subject matter for reproduction.

To support these warranties, the customer agrees to indemnify and hold SoBeGraphics.com harmless for all liability, damages, and attorney fees that may be incurred in any legal action connected with copyright infringement involving the work produced or provided. Personal or economic rights: The customer also warrants that the work does not contain anything that is libelous or scandalous, or anything that threatens anyone's right to privacy or other personal or economic rights. The customer will, at the customer's sole expense, promptly and thoroughly defend SoBeGraphics.com in all legal actions on these grounds as long as SoBeGraphics.com promptly notifies the customer of the legal action and gives the customer reasonable time to undertake and conduct a defense. SoBeGraphics.com reserves the right to use his or her sole discretion in refusing to print anything he or she deems illegal, libelous, scandalous, improper or infringing upon copyright law

TAXES: All amounts due for taxes and assessments will be added to the customer's invoice and are the responsibility of the customer. No tax exemption will be granted unless the customer's "Exemption Certificate" (or other official proof of exemption) accompanies the purchase order. If, after the customer has paid the invoice, it is determined that more tax is due, then the customer must promptly remit the required taxes to the taxing authority, or immediately reimburse the provider for any additional taxes paid.
